H-2B VISA Summary

PURPOSE:

To obtain temporary H-2B Visa status, based on appropriate temporary, seasonal job offer.

DURATION:

The duration is:
a. by season (spring, summer and fall, March - November)
(i.e.; landscape workers or soccer coaches)
b. one time contract or peak load (i.e.; manufacturing operation)

NATURE OF JOB OFFER:

Offer of employment must be for temporary position, based on seasonal need (i.e.; landscape worker, soccer instructor) or
one-time contract or peak load (i.e., manufacturing setting).

QUALIFICATIONS OF ALIEN:

Alien (Employee) must meet minimum qualifications in experience and/or education as set forth in the offer of employment appearing on Form ETA750 Part A, Item #14.

TESTING OF LABOR MARKET:

Advertisement for position must appear in local newspaper for three days for purposes of testing labor market for available, qualified U.S. workers.

UNAVAILABILITY OF U.S. WORKERS:

Department of Labor (DOL) must certify that qualified U.S. workers are not available for the temporary/seasonal position.

FINANCIAL EVIDENCE OF EMPLOYER:

Employer must be able to demonstrate that alien's salary can be paid as of the year of filing with DOL (i.e., business tax return, financial statement, business bank statements).

PROCESSING TIME:

Application must be submitted to DOL no earlier than 120 days prior to start date.
