H2 Seasonal Workers

H2 visas for seasonal workers

Most temporary visas are issued to professional workers or investors. However, sometimes the demand for certain temporary visas can outstrip the supply for them, especially for those sought for agriculture and construction workers. At The Law Offices of Susan W. Scheer, we have counseled employers on the use of temporary visas for over 20 years. If you need employees for your busiest season, we can help. H2 Visas

Seasonal visas target different industries at different times. Trades that are affected include landscaping and construction work, agricultural trades, and hospitality resources. There are two types of H2 visas. H2A is dedicated to agricultural workers only. H2B visas may be issued to coaches, sports landscapers, construction workers, and other types of temporary non-agricultural workers. All H2 seasonal worker visas are temporary. Unlike the holder of an H1 visa, an H2 visa holder cannot renew his or her visa. They must return to their home country once their visa expires. If they hope to reenter the country to do the same type of work, they must return to their home country and re-file.

Legal Services

Usually, an employer is the first person to contact us. We evaluate their employment needs, and advise them of their options. Once the employer has decided to hire seasonal workers, we guide them through the H2 process. As necessary, we correspond with individual employees so that we can coach them before their visa interview.
