As a New Jersey Immigration Lawyer, I recently spoke to a woman who was married to a with an approved I-130 Visa petition. She was in abusive relationship and wanted to know if she left him, would the I-130 be removed?
- There is a program called VAWA (Violence Against Women act) which she could apply for. This program is also available for men.
- You must be cohabitating with the individual and actively married, along with showing proof that the marriage was legitimate.
- You will be able to sponsor yourself at this point with the I-360 petition, while providing proof of the marriage and the abuse.
