What is the difference between a Visa Waiver and a B Visitor Visa?
- A Visa Waiver is a program that 40 countries engage in, but only lasts 90 days.
- With a Visa Waiver you must travel to the U.S. Embassy in the United States.
- The B Visitor Visa requires you to visit the U.S Embassy in your home country.
Can I extend my 90 day Visa Waiver?
- The Visa Waiver Program allows people to obtain a quick visitor visa without going to the US embassy for 90 days as long as you do not have a criminal record.
- You are unable to extend your stay past the 90 days and you are unable to convert the waiver into something else.
- If you visit the US Embassy and provide proof of your plan, you can stay up to 6 months, but you would need to file an I-94 authorization.
Can I file for a travel document on a work Visa?
- Immigration will allow a valid DACA recipient with a valid work permit to apply for a travel permit with the I-131 Form.
- Immigration will allow this under the following circumstances with proof:
- Educational reasons, like studying abroad for a short term program.
- Short term business travel
- Humanitarian reason, like visiting a sick family member or funeral.
- You will not be granted the travel permit for any other reasons.
Is it possible for me to study abroad if I have a green card?
- USCIS created the I-131 form which allows you to obtain a reentry permit, which gives you the option to stay outside of the U.S. for two years.
- You are required to submit fingerprints when applying for reentry, and proof of why you want to stay abroad.
